Understanding the Causes & Types of Cerebral Palsy
Research indicates that nearly 10,000 infants are diagnosed with cerebral palsy each year. This staggering number may be greater in actuality, as a proper diagnosis may not be made for a few years after birth. When caused by medical malpractice, cerebral palsy can result from many mistakes, including a lack of oxygen to the baby's brain and birth trauma.
It is important to determine the root of these medical mistakes. Whether a doctor failed to appropriately monitor fetal heart rate during labor or neglected to identify a prolapsed umbilical cord, those responsible must be held accountable for their negligence.
There are many different types of cerebral palsy, each ranging in severity, including:
- Spastic cerebral palsy: Makes up the majority of most diagnoses and is characterized by stiffness and difficulty moving. Patients suffering from spastic cerebral palsy struggle to change positions.
- Athetoid cerebral palsy: Roughly 10 percent of cerebral palsy cases are attributed to this type. Symptoms include involuntary movement, slurred speech, and low muscle tone.
- Ataxic cerebral palsy: Also accounts for around 10 percent of cerebral palsy cases. Ataxic cerebral palsy patients struggle with vision, balance, and muscle movements.
Impact of Cerebral Palsy on Life Expectancy
Cerebral palsy is a lifelong condition that can impact a child's physical and cognitive abilities. One of the common concerns among parents is whether cerebral palsy can affect life expectancy. While cerebral palsy itself is not a progressive disease—meaning it doesn't worsen over time—the severity of the condition and the presence of related health complications can influence life expectancy.
Children with mild forms of cerebral palsy often have a life expectancy similar to their peers without the condition. However, more severe cases, particularly those involving significant mobility issues, intellectual disabilities, or other health challenges, may face a reduced life expectancy. Factors such as respiratory difficulties, feeding problems, seizures, and the overall level of mobility can contribute to this. Regular medical care, therapeutic interventions, and support can greatly enhance the quality of life and may improve life expectancy for children with cerebral palsy.
It is important to note that each case of cerebral palsy is unique, and predicting life expectancy can be complex. Families are encouraged to work closely with healthcare providers to manage the condition and address any complications that may arise. This comprehensive approach can help mitigate some of the risks associated with cerebral palsy and lead to a longer, more fulfilling life for the child.
Compensation Options for Cerebral Palsy Birth Injuries
When cerebral palsy is caused by a birth injury—particularly one that could have been prevented with proper medical care—families may be entitled to compensation. This compensation is meant to help cover the extensive costs associated with caring for a child with cerebral palsy and to provide financial security for the future.
The types of compensation that families may receive in a cerebral palsy birth injury case can include:
- Medical Expenses: The cost of medical care for a child with cerebral palsy can be overwhelming. Compensation may cover past, present, and future medical expenses, including hospital stays, surgeries, medications, physical therapy, occupational therapy, and specialized equipment.
- Rehabilitation Costs: Many children with cerebral palsy require ongoing rehabilitation services to improve their motor skills and overall functioning. Compensation can help pay for these essential therapies, which can be a significant financial burden over time.
- Special Education and Support Services: Children with cerebral palsy may need specialized education and support services. Compensation may cover the cost of special education, tutoring, and other resources designed to help the child reach their full potential.
- Home Modifications: Depending on the severity of the condition, families may need to make modifications to their home to accommodate their child's needs. This could include installing ramps, widening doorways, or making bathroom renovations. Compensation can help cover these costs.
- Lost Wages: Parents often need to reduce their work hours or leave their jobs entirely to care for a child with cerebral palsy. Compensation may include coverage for lost wages, helping to ease the financial strain on the family.
- Pain and Suffering: In addition to economic damages, families may also be entitled to compensation for the pain and suffering caused by the birth injury. This includes both the emotional distress experienced by the child and the parents.
- Future Care Costs: As children with cerebral palsy grow older, their care needs may change. Compensation can provide for long-term care, ensuring that the child receives the support they need throughout their life.

When I say..you’ve reached the right people..ur lucky to be in contact with them!! Although they couldn’t help me with my case. Leading up to the decision Lori kept in contact, showed empathy, and was straightforward with all detail! Lori told me more than my own doctors or the hospital did. I have closure because of HER! So I still won! My case was complicated to move forward due to other reasons..but she ain’t never let me down when speaking to her! She speaks to you as if she knew you forever! I appreciate this firm so much because before they say NO..they try, they listen, and they put work in!!! Thank you guys so much for everything!- Adrian W.

From the first phone conversation with Lori, to the first time meeting with David and Jeff, all the way through and to the conclusion of my case, I felt as if these people truly cared about what happened to me. They didn’t just see a potential “case”. They were upset with my situation. They wanted to help. Through the years that this whole process takes, I have gotten to know them a bit better, and they have gotten to know me. I now consider them less “my legal team”, and more a part of my extended family, whether they realize it, or like it, or not. I so appreciate their kindness, genuine compassion, and “got my back” attitude. I hope you are never in a situation to need these folks, but if you ever are, I highly recommend talking to them and seeing if it’s a right fit for all.- Joel F.

I never thought that anything would ever happen to me that would lead me to post a review about this law office. Unfortunately, I was wrong and what happened was completely unimaginable so much so that police didn’t believe it at first. I was so confused and lost because it seemed that no one believed me. I googled malpractice in Florida and this was one of the offices that popped up. I called and spoke with Lori, the paralegal, and told her everything she believed me and Jeff and David did too. Due to what happened this wasn’t going to just be a civil lawsuit but a criminal one as well. They were a huge help in working with the police to get items that would prove my criminal case and would lead to felony arrest and jail time. They were there to talk to me all throughout the criminal case. Especially, Lori she truly cared and when I was all alone feeling that I wasn’t strong enough to get through this she was always there with good and caring advice. I was with this law firm for the past 3 years and Jeff and David are very compassionate and kind. From the attorneys to the paralegal they worked very hard and did so much that they have changed my life. If you are looking for an attorney office with experienced, knowledgeable, and compassionate staff. I promise they won’t let you down.- Tiffany S.
